An inmate has filed a negligence claim against Curry County, charging she was bitten several times in a fight with another jail inmate who is HIV positive.
La Monda Keith’s attorney Eric Dixon of Portales identified the attacker as a 34-year-old woman in a tort claim he filed March 25.
Dixon said Keith, 53, was bitten repeatedly on the leg during a scuffle March 7 in the outside recreation area of the jail’s female section. Dixon said he didn’t know what started the fight other than his client maintains she was jumped during a shakedown.
Dixon said Keith was later informed by jail staff that the alleged attacker was HIV positive and Keith needed to be tested for possible infection. Results of the test are still not known and Keith will have to be tested periodically for at least the next six months, he said.
Jail Administrator Tori Sandoval declined any comment, citing the threat of litigation.
